PROTECTING MINORS

In accordance with article L. 3342-1 of the French Public Health Code, which stipulates that the sale of alcohol to minors under the age of eighteen (18) is prohibited, the Customer undertakes, by completing the order form, to be at least eighteen (18) years of age on the date of the order. Alcohol abuse is dangerous for your health, and should be consumed in moderation. The products sold on this website contain alcohol and should be consumed in moderation.

PRODUCTS, PACKAGING AND PRICES

The Vendor sells wines, hereinafter referred to as "Products", via the Internet site.

- Orders are delivered in boxes of 6 or 12 bottles.

- You can mix and match your order by choosing each wine individually, with a minimum of 6 bottles per order.

- Bag In Boxes are delivered in packs of 4. 

- Half-bottles are delivered in boxes of 12.

- The TOTAL price, hereinafter referred to as the "Price", indicated in the order confirmation is inclusive of VAT and is final. This Price includes the price of the Products, handling, packaging and transport costs. The Price is expressed in Euros.

- The cost of transport is calculated automatically by the website, according to the number of bottles.

- Discounts may be granted to the Customer depending on the quantity of Products ordered, or in the case of orders of products identified as "On special offer", delivered to the same address in mainland France.

- For an order of 6 bottles, shipping costs of €15 will be automatically applied by the website.

- For orders of 12 bottles or more (mixed or not), shipping is free.

- For all orders greater than or equal to 36 bottles (for Bag In Box 1L = 1 bottle) a discount of 0.90 € TTC per bottle will be automatically applied by the website.

- Goods remain the property of the Seller until full payment has been received.

PAYMENT

The present merchant website allows the Customer to make payment in several ways:

- by bank or postal cheque, to be sent by post to the Vendor's postal address above,

- by bank transfer, to be made directly from the customer's bank account to the Vendor's bank account (the RIB is sent to the customer by the website when the order is confirmed),

- by credit card: this method allows the customer to pay directly online. Once the order has been validated on the Vendor's site, and the order number assigned, the customer is redirected to the Vendor's bank's secure site (Terminal de Paiement Electronique - TPE). This site must be displayed using the secure protocol https:// in the Customer's Internet browser.

The Eftpos terminal installed on this site performs an enhanced identification of the customer's bank card, known as 3D SEcure (MasterCard) or Verified by Visa (VISA). In the first phase of this double identification procedure, the Customer is asked to provide his/her bank card number, expiry date and the security code on the back of the card. In the second phase, the bank connects to the bank issuing the credit card, and asks the customer for further codes specific to each bank. Customers should contact their bank if they encounter any difficulties in step 2 of the identification process.

TRANSPORT - DELIVERY TIME - RESERVATIONS

The present Internet site allows the Customer to make payment in several ways:

- Products are delivered to the delivery address indicated in the order, by the carrier appointed by the Vendor. The Vendor undertakes to deliver the Products within a maximum of 10 working days, except in the event of extreme weather conditions making the transport of Products inadvisable (extreme heat or frost). In the event of failure to meet this deadline, the Customer may ask the Vendor to cancel the order outright. In the absence of the recipient or of a person who can take possession of the products at the time of delivery, the carrier will leave a calling card at the delivery address indicated by the Customer.

Important instructions :

- A permanent presence at the delivery address is required.

- Monday to Friday, 9am to 5pm.

- In the event of delivery not being possible within 15 days, an additional charge will be invoiced.

Reservations on delivery :

The customer may make any necessary reservations to the carrier by registered letter with acknowledgement of receipt within 3 days of receipt, in accordance with article L.133-3 of the French Commercial Code. Any product that has not been the subject of reservations will be considered accepted by the beneficiary and will release the seller from all liability towards the Customer. The Customer may express reservations upon delivery of the Products if :

- the delivery does not conform quantitatively to the order,

- the package(s) containing the Products is (are) badly damaged.

The Customer must also inform the Vendor by letter, e-mail or telephone, no later than 12 hours after these reservations have been made. It is the Customer's responsibility to provide the carrier's confirmation of these reservations. The customer may also refuse damaged packages, stating for example "1 package refused for breakage and 2 packages received in good condition". In this case, the Customer must also inform the Vendor by post, e-mail or telephone, no later than 12 hours after the package has been refused.

If the above procedure has been followed, and if it is thus proven that the reservations are due to the fact that the package and the Products are badly damaged, the Vendor will, at his discretion, refund the Customer the Price paid or make a new delivery of similar Products.

If the delivery does not conform quantitatively to the Order, at the Customer's option, the Vendor will refund the price of the missing Products, or make a new delivery within 10 working days.

RIGHT OF WITHDRAWAL

In accordance with the law in force, the buyer has a right of withdrawal of 14 days from receipt of the goods. Purchasers exercising this right must return the merchandise in its original packaging (unopened bottles) to the Vendor's address, at their own expense and responsibility. The Vendor will reimburse the purchaser by bank cheque within 14 days of the return of the Products. The refund will include the cost of delivery to the Customer. The Customer is responsible for return shipping costs.

DATA CONFIDENTIALITY

The placing of an order requires the recording of certain elements concerning the Customer (surname, first name, address, e-mail address). In application of the French Data Protection Act of January 6, 1978, the customer has the right to access, rectify and delete recorded data. They may also assert their rights by contacting the Vendor directly by post, e-mail or telephone.

INVALIDITY - FORCE MAJEURE - APPLICABLE LAW - COMPETENT COURTS

Should any of these General Terms and Conditions be declared inapplicable or be invalidated for any reason whatsoever, this will not affect the application or validity of the other provisions of the General Terms and Conditions, the invalidated or inapplicable provision being replaced by the closest possible provision.

Neither the Seller nor the Customer shall be held liable for any failure to perform due to force majeure beyond its control, including but not limited to war, riot, insurrection, interruption of transport, import or export problems, strike, blackout, shortage, fire, earthquake, storm or flood. These General Terms and Conditions are governed exclusively by French law. The courts of Avignon shall have exclusive jurisdiction over any dispute or difference concerning them.
